Statutory Legal Boundary & Professional Responsibility

Governed by the Advocates Act 1961, Bar Council of India Rule 36, SPT Act 1949, & CNT Act 1908

1. Non-Legal Practice Declaration (Advocates Act, 1961)

LandAmin is an engineering and cadastral land-specialized professional services entity. LandAmin is not a law firm, does not practice law, and does not provide formal legal representation before any Court of Law, Revenue Court (DCLR/Collectorate), or Land Acquisition Tribunal.

Under Rule 36 of the Bar Council of India Rules and Section 30 of the Advocates Act, 1961, corporate entities are strictly prohibited from soliciting legal work, sharing professional legal fees, or providing direct advocacy. Any legal vetting, title opinion, or court representation coordinated through LandAmin is rendered directly and independently by qualified, independent advocates enrolled with the Bar Council of Jharkhand or Bihar.

2. Nature of Cadastral & Ground-Truth Reports

LandAmin Ground-Truth Reports, Total Station traverse logs, and cadastral reconciliation maps represent technical, factual, and observational evidence derived from physical land measurements, official village revenue maps (CS/RS Naksha), tri-junction pillars (Sehadda), and inspected registry records.

Our reports provide ground evidence to assist landowners, buyers, and independent advocates in evaluating property status. They do not constitute a statutory guarantee of title or a guarantee against future third-party litigation. Statutory title in India is governed by the Transfer of Property Act 1882, the Registration Act 1908, and local state tenancy legislations.

3. Tenancy Law Screening Notice (SPT & CNT Acts)

Land transactions in the Santhal Parganas Division (Deoghar, Dumka, Godda, Jamtara, Pakur, Sahibganj) are strictly governed by Section 20 of the Santhal Parganas Tenancy (Supplementary Provisions) Act, 1949. Rayati (agricultural) lands are non-transferable by sale, gift, or mortgage unless specific statutory exceptions apply. Similarly, tribal lands in Chota Nagpur are governed by the CNT Act 1908.

LandAmin enforces a strict Refusal Policy: we will not facilitate or certify transactions that violate statutory tenancy laws or attempt to legitimize fraudulent encroachment on public or communal (Gair Mazarua / Gochar) lands.
